Dealing with food outlet and shop front litter within Muswellbrook Shire

Litter deposited by food shop patrons onto footpaths and grime build-up on shop frontages can be unsightly and unhygienic to the general public.

Responsibility lies with owners and occupiers of the premises

Both owners and occupiers are responsible for maintaining their premises in a healthy condition and ensuring waste generated by the business is dealt with satisfactorily.

In the interest of the health and amenity of the Muswellbrook Shire, Council encourages all business operators to maintain their premises in an attractive and healthy condition.

This can be assisted by maintaining a cleaning program for the shop frontage and surrounds of the premises. Providing bins for cigarette butts and litter will also assist in the reduction of litter.

It is an offence to keep a premises unsightly and unhealthy

Muswellbrook Shire Council has the powers under the Local Government Act to pursue legal action on the operators of business or land owners where sufficient evidence demonstrates that waste from the premises is not being handled satisfactorily or the premises is unsightly due to presence of litter on the land which is in the view of the public area. It is also an offence to deposit litter onto a public area such as streets or footpaths.
